Terms and Conditions of Cardiff Bay Leisure Limited trading as Cardiff Sea Safaris
In these terms and conditions the term “company” refers to “Cardiff Bay Leisure Limited”, including directors, skippers, staff or any other sub-contracted person.
The term “child fare” will be applied to children up to and including age 14 years.
The term “client” refers to the person whose name the booking was made in.
The term “passenger” refers to those named on the customer declaration form signed prior to the trip.
The term “booking” refers to any event or work conducted by the company on behalf of its clients

1.1. If, through circumstances beyond its control, the company is unable to meet any booking, the client may be offered another booking at the company’s discretion.
1.2. If the company is unable to offer the client or the client is unable to accept another booking, the company will refund the booking fees paid. The company’s liability is limited to this and does not extend to any other expenses.
1.3. The company reserves the right to cancel or amend any booking including, and not limited to, whether the booking proceeds to sea, when and how bookings are conducted. The company’s decision is final.
1.4. Each booking, whether a private charter or individual seats, must be accompanied by at least one responsible adult 18 years of age or over.

2.1. A clients/passengers place on a booking is confirmed when we receive a non-returnable deposit of 50% of the overall booking fee.
2.2. A clients/passengers place on a 15 minute bay blast is confirmed when we receive the non-returnable full booking fee.
2.3. Full payment for all bookings are required prior to boarding the vessel. Payments can be made by cash, credit/debit card or by bank transfer.  
2.4. All fees associated with a bank transfer by the client must be paid by the client.
2.5. Inappropriate or malicious operation of the life jacket’s manual firing mechanism will be subject to a £50 servicing fee.
2.6. Additional adults on Children’s Parties will be subject to an extra supplement of £5 per adult for each 30 minutes.

3.1. Only gift vouchers issued and authorised by an official representative of the company can be redeemed against our services, the voucher has no financial face value and cannot be exchanged for money.
3.2. A voucher will be issued for the prescribed period of time stated on the voucher, usually 6 months from the date of purchase, this cannot be extended under any circumstances.
3.3. Gift vouchers cannot be used against services other than for which they were purchased.
3.4. A clients/passengers place for a booking is confirmed when we receive the voucher serial number at the time of the booking, clients/passengers will not be able to board the vessel without surrendering the gift voucher.
3.5. All other terms and conditions apply.

4.1. Cancellations for any booking must be made in writing by email or letter to the company, stating the reason for cancellation.
4.2. Cancellation of bookings seven days or more before the booking date will receive a refund less £10 administration charge.
4.3. Cancellations of bookings seven days or less before the booking date will forfeit the booking fee.
4.4. The company shall not accept liability for any other claims and shall not be liable at any time for claims or expenses caused by circumstances beyond its control including sickness, accident, mechanical failure, weather, travel delays, strikes, war or civil unrest.

5.1. The company holds insurance to cover all of its activities.
5.2. The company accepts no liability for theft, loss or damage for clients clothing, equipment and personal property howsoever caused.
5.3. The client/passenger acknowledges that there are inherent dangers involved in watersports and understands that by signing the declaration form the client/passenger agrees with these terms and conditions.
5.4.  The client/passenger agrees to holding the company free of any liability in the event of an accident, death, injury or damage to person or property where the clients/passengers are in breach of our safety instructions or the client’s/passenger’s negligence is deemed to be a contributing factor to the incident.

6.1. All passengers must meet the minimum height of 1.2 meters during public trips, the skippers discretion to height restrictions may be used during full boat private hires, in either case the decision of the skipper is final.
6.2. All passengers, without exception, must be coherent, and have the ability to hold onto the handholds independently throughout the trip, any passengers with disabilities must have an appropriate number of helpers to assist them if needed.
6.3. Any passenger under the influence of intoxicating substances, including alcohol, will not be permitted to board the vessel.
6.4. Any passenger that is pregnant will not be able to take part in our high speed trips.
6.5. Any passenger with pre-existing medical conditions, such as back, breathing or heart conditions must inform the skipper prior to boarding.  The skipper’s decision on whether you are able to participate is final.
6.6. By signing the declaration form clients/passengers accept all of the above terms and conditions.
